With the opening of the 114th Congress came much welcome relief to apartment owners and managers who rely on terrorism insurance coverage for their properties. The Senate and House overwhelmingly approved the Terrorism Risk Insurance Program Reauthorization Act of 2015 (H.R. 26), which extends the program for six years.
FAA partnered with NAA and the National Multifamily Housing Council to advocate for reauthorizing the Terrorism Risk Insurance Act (TRIA), which expired at the end of 2014 after Congress failed to pass legislation to keep the act in effect.
Courtney Barnard, FAA government affairs director, and Greg Brown, NAA vice president of government affairs, traveled to Washington, D.C., in November to urge members of Congress to support the reauthorization. They met with U.S. Rep. Patrick McHenry (R-N.C.), deputy house whip, as well as with U.S. representatives John Mica (R), Patrick Murphy (D), and Dennis Ross (R).
The act provides apartment owners with subsidized property insurance for protection against terrorist acts. Many mortgages require the owner to carry this insurance.
The NAA and NMHC report that the reauthorization did not simply extend the program, it also made some modest changes aimed at increasing taxpayer protections and private market participation. Specifically, it incrementally raises the program trigger to $200 million from $100 million and reduces the federal loss share from 85 percent to 80 percent. It also increases the level of federal recoupment by $10 billion.
In addition, studies to assess future private market capacity and various program funding options are to be presented to Congress. The compromise package overall represents a win for the policyholder community and ensures continued stability in the real estate market.
ORLANDO, FLA., January 20, 2015: Funding for affordable housing programs, regulation of apartment maintenance workers, and potential expansion of protected classes of citizens are among the topics the Florida Apartment Association (FAA) plans to address with legislators prior to the opening of the 2015 legislative session. FAA representatives plan to meet with legislators at the organization’s annual Legislative Days conference Feb. 17 and 18.
Supporting Sadowski Affordable Housing Trust Fund
"This year, more than ever, the FAA considers continued funding of the Sadowski Affordable Housing Trust Fund an important priority," said Glenn Evers, chairman of FAA’s Government Affairs Council and Legislative Committee. Already over the past few years, he explained, funds have been redirected into the general fund instead of going toward loans to renovate and retrofit apartment communities for Florida’s elderly, disabled, and other vulnerable populations, for example. "Then in November, Florida voters approved an amendment to the state constitution allocating a portion of document stamp taxes to land and water conservation. In order to protect affordable housing programs, they need the full allocation of the Sadowski Trust Fund money."
FAA recently became one of the 30 diverse organizations that make up the Sadowski Coalition, which estimates that putting the estimated $245.33 million in the state and local housing trust funds in fiscal year 2015-16 into Florida’s housing programs will create 24,820 jobs and $2.5 billion in positive economic impact in Florida.
Supporting Expansion of Scope of Work Performed by Maintenance Workers
Under Florida State Law (Unlicensed Maintenance), apartment maintenance workers are prohibited from performing many basic repairs. FAA proposes that law be revised to permit workers holding a Certificate for Apartment Maintenance Technicians (CAMT) to perform these types of repairs. The certification program includes more than 90 hours of coursework and is accredited by the American National Standards Institute (ANSI), a private nonprofit organization that administers and coordinates the U.S. voluntary standardization and conformity assessment system.
"The maintenance work we’re talking about includes repairs many homeowners do themselves — or hire a handyman to perform," explained Courtney Barnard, FAA’s government affairs director. "Allowing trained and certified apartment maintenance workers to carry out these repairs means the work can get done faster and more cost-effectively. That’s a win-win for owners and residents alike."
Opposing the Creation of Additional Protected Classes
Federal and state fair housing laws prohibit discrimination based on factors such as race, color, religion, national origin, gender, and disability. The FAA fully supports compliance with these laws, and offers members educational programs and other resources.
The FAA is concerned that adding certain protected classes, such as people with criminal records, could pose liability and safety issues.
"Residents want to feel safe in their homes, and of course apartment community owners must take steps to protect their communities," Barnard said. "Background checks — including arrest records and criminal convictions — are important tools to do just that."
The FAA will pursue an academic study of insurance liability issues to assess what steps can be taken to create a more affordable insurance market for apartment communities. The results of the study will help FAA prepare for legislative efforts in 2016 and beyond.

ORLANDO, Fla., January 9, 2015: The Florida Apartment Association (FAA) has joined a nonpartisan coalition of 30 organizations dedicated to the full funding of the affordable housing programs established more than 20 years ago by the Sadowski Act and financed through taxes on real estate transactions.
Under the Sadowski Act, a portion of all document stamp taxes go into a trust fund that is used to support the State Housing Initiatives Partnership (SHIP) and the State Apartment Incentive Loan (SAIL) program. SHIP provides money to counties and cities for housing programs; SAIL funds can be used to renovate and retrofit existing communities or build new communities to accommodate people with disabilities, the elderly, veterans, and other vulnerable populations.
"A significant number of our member communities provide affordable housing to the residents who need it most," said Ron Wenzel, president of FAA and senior regional property manager of Greystar Real Estate Partners. "Thirty percent of the trust fund money allocated each year goes toward helping them continue to do just that. So it only made sense for us to have a voice at the table."
Courtney Barnard, FAA government affairs director, met with members of the Sadowski Coalition earlier this week to discuss plans to gain support among legislators.
"We are looking forward to working with Senator Andy Gardiner in the 2015 session to again fund affordable housing," Barnard said. Gardiner, president of the Florida Senate and a long-time supporter of affordable housing, was honored at the FAA’s annual meeting in October as Legislator of the Year for 2014. "This year, we have a bigger challenge than ever. Not only have the Sadowski Trust Fund monies been swept into the general fund in recent years, but the passage of state constitutional Amendment 1 in November means a portion of the doc stamp money will now go to water and land conservation programs — money that would otherwise have gone to the Sadowski Fund."
"It’s important to realize that these affordable housing programs benefit not just Florida’s residents who are most in need," added Josh Gold, FAA executive vice president. "They also help the state’s economy overall. When SAIL funds are used to refurbish deteriorating apartments and build new apartment communities, that creates jobs and an overall positive economic impact."
The Sadowski Coalition includes business and industry groups such as FAA; government and planning organizations; faith-based organizations; and advocacy groups for the elderly, veterans, homeless, and people with special needs.

JACKSONVILLE, Fla. (January 12, 2015) - LandSouth Construction, an award-winning Jacksonville, Fla. based general contractor specializing in multifamily and senior housing, has begun construction on the Village on Wiley, a $4 million apartment community on Jacksonville’s Westside.
The development is located on 4.3 acres and consists of 43 residences and a clubhouse in 12 buildings. The one-bedroom, one-bath apartments are approximately 500 square feet. Construction is expected to commence on Dec. 1 and is scheduled for completion in the summer of 2015.
The developer is Ability Housing of Northeast Florida, Inc., the only not-for-profit in Northeast Florida that focuses on the development and operation of quality, affordable, rental housing for individuals and families experiencing or at risk of homelessness and adults with a disability.
The project is being funded by Florida Housing Finance Corporation.
PQH Architects is the designer for the unique quadplex units. PQH is a full-service planning, architectural, and interior design firm located in Jacksonville, Fla. Since 1982, the firm has completed projects across Florida, throughout the Southeast and across the Nation.

Joint Venture Acquires Student Housing Community in Orlando

ORLANDO, Fla./RALEIGH, N.C., January 05, 2015 — Officials of The Preiss Company, the nation’s third largest, privately held student housing owner-operator, today announced that it acquired in a joint venture the 624-bed Orion on Orpington student housing complex near the University of Central Florida (UCF) from Orlando Student Venture, LLC for an undisclosed amount. The joint venture is comprised of a private investment group and The Preiss Company who is the sponsor and property manager.

Wood Partners Leases 29 Apartments at The Rialto, a 200-Unit Lakefront Community in Orlando

Balfour Beatty Communities expands footprint in Florida: awarded management of three multifamily properties in Sarasota

LandSouth Construction starts contemporary urban mixed-use apartment project in UPtown Delray
JACKSONVILLE, Fla. – (January 12, 2015)-- LandSouth Construction, a Jacksonville, Fla. based general contractor specializing in multifamily and senior housing, has begun construction on UPtown Delray, a $26 million mixed-use apartment community in Delray Beach, Fla.
"This contemporary urban project has two buildings connected by a pedestrian bridge," said Joe Passkiewicz, vice president of operations for LandSouth Construction. "One building will be apartments over a parking structure. The other is mixed-use with retail and office space as well as apartments. Crocker Partners Teams with Cornerstone Real Estate Advisers to Reacquire Boca Center, Premier Mixed-Use Center
BOCA RATON, FL-January 6, 2015 — Crocker Partners, a fully integrated real estate company with an 8 million-square-foot portfolio valued at nearly $2 billion, and Cornerstone Real Estate Advisers LLC, acting on behalf of a Cornerstone-managed fund, today announced the acquisition of the mixed-use Boca Center, one of Boca Raton’s most prominent properties.
