2023 Session Update: Week 9

All of FAA's priority legislation crossed the finish line during the 2023 Legislative Session, making it the most impactful year ever for housing in the state.

After 60 days, 1,873 bills filed, and 3,229 votes later, the session officially concluded on Friday, May 5 with the passage of the $117 billion state budget. In addition to engaging in budget discussions, FAA actively tracked 88 pieces of legislation. In total, the legislature passed 356 bills.

Housing opportunity was a top priority for Senate and House leadership, and the Florida apartment industry secured some major wins as a result with all four of FAA's legislative priorities awaiting final approval by the governor.

Insurance and Premises Liability

  • HB 837 was signed by Governor DeSantis on March 24 and went into effect immediately.
  • This legislation addresses rising property insurance costs and includes a variety of key reforms to Florida's legal system.

Property Tax Discounts and Addressing Apartment Scarcity

  • SB 102 was signed by Governor DeSantis on March 29 and will take effect July 1, 2023.
  • This legislation provides a record-breaking $811 million for affordable and workforce housing and a variety of creative tools to address Florida's housing supply needs.

Fire Radio System Communication Requirements

  • HB 1575 passed both chambers unanimously and awaits final approval by the governor.
  • If signed, this legislation will take effect July 1, 2023.
  • HB 1575 provides a clear framework for fire radio system communication enhancements and will nullify ordinances with more stringent requirements.

Florida Landlord Tenant Act Protections

  • HB 1417 passed both chambers and awaits final approval by the governor.
  • If signed, this legislation will take effect July 1, 2023.
  • This legislation preempts the regulation of the landlord/tenant relationship to the state and will nullify existing ordinances.
